Hi All,
Need some comments on my situation. My lawyer filed for my I-140, I-485, AP, and EAD on November 20th on EB2 Row Category. I just emails yesterday stating that my EAD card is sent to production, but they have asked for initial evidence on 485. Is it possible to review 485 without looking at the 140? I am not sure what that query is, but really hoping that it is not something serious. I've already waited for 16 months for my Labor to get approved. Please share your experiences, suggestions etc. regarding this.
yes, 485 processing and 140 processing is different. They are joined thread, So they will not approve 485 until your 140 is approved.

My father (over 60 years) is coming to the States in June 15, and his B1 visa expires on June 24. However, my father is planning to stay until August 20.
My question is:
Will he be able to stay after his visa expiration date?
In other words, when will his I-94 expire?

They will take your I-94 at the airport in washington where you will board your flight....
In my experience my previous I-94 was issued to me on AP for one year when I had come in......they did not bother with the I-94 on my H1B.
Anyways since yours is an international flight the agent at the counter will take care of whichever they want.....just present them with both. Mostly they do not bother with the one in I-797 notice.

Below is the family based catgory, you can find this in any visa bulletin too.

Second: Spouses and Children, and Unmarried Sons and Daughters of Permanent
Residents: 114,200, plus the number (if any) by which the worldwide family preference level exceeds 226,000, and any unused first preference numbers:
A. Spouses and Children: 77% of the overall second preference limitation, of which 75% are exempt from the per-country limit;

I am on H1B visa. My visa expires in April 2010. I was arrested in New York for a misdemeanor charge which was subsequently dismissed by the court. There was no guilty plea etc so under immigration law too I DO NOT have a conviction. I have all the final court docs. I am travelling to India to renew my H1B visa. I have a few questions -
(i) Is there a possibility that I am selected for 221 g screening? How long does the 221 g screen take?
(ii) Since I have a valid visa am I allowed to enter the US while they are completing the process? I have left the country before and entered on my current visa. I was sent for additional screening at the airport but had no issues since I have all the court documents.
Any insights would be appreciated

The idea of a H1 transfer is a misnomer. Every application is a new H1. However, if you already are in a valid H1 nonimmigrant category then your new application is not subjected to the cap.

My wife last time entered to US with H4 in June 2010. Then she applied for F1 status and got approved in Nov 2010.
H4 visa stamping Expires on Feb 20111.
She is planning to go India by Jan 2011 for 2 weeks. She is planning to come before Visa expires.
Is it possible to enter US with old H4 visa stamping?
Do we really need to stamp visa with F1?
F1 visa stamp is needed if she plans to continue her studies on F1 and would like to avail OPT.

I suspect, if the camera has a chargable clock battery, it's NOT a "user-servicable" part. The idea is that they don't break.
That's just a guess - I don't have a D70, so I don't know for sure.
I did a few entries in Google, with the result that I'm fairly sure the clock-battery is an internal non-user-changable battery [particularly a reference to the same technology being used on a Nikon D1].
I expect that aside from the inconvenience and shipping cost, the service is fairly reasonable in cost... But that's just a guess...

Hello,
I need some advice concerning my application for a B2 Tourist Visa to the US as my wife and I wish to travel to Disneyworld Florida next December to celebrate our belated honeymoon:
I received a police caution in March this year for "Battery" under Section 39 of The Criminal Justice Act after a domestic argument with my wife here in the UK.
I also have a UK driving conviction from 2006 for "Driving Without Due Care and Attention" which resulted in a �100 fine and six points on my licence which have now expired.
Do either of these cautions/convictions constitute a crime of "moral turpitude"?
I am rather concerned that although I have read that a simple assault/battery does NOT constitute "moral turpitude," spouse abuse certainly does under US law.
Does the definition of simple battery or spouse abuse depend on which country the caution was received in?
The incident in question was more of an argument than one of domestic violence. I grabbed my wife's arm and she twisted herself trying to get away from me and she fell over which left her with a minor bruise and scratch. I certainly did NOT use any deliberate force or physical violence towards my wife.
The argument arose because I had been unemployed for over a year and my wife was stuck doing a job she hates and financial difficulties at the time had put a strain on our relationship. Now that I have secured a full time job and our financial problems have depleted, the relationship between my wife and I is very stable and loving.
However, if the consular officer at the embassy decides that this is a crime of moral turpitude, would I still be eligible for "petty crime exemption" (as the maximum sentence for a Section 39 battery crime is six moths in jail) even though I have the driving conviction from 2006?
Any assistance and guidance on this matter would be greatly appreciated.

This is the wording i saw at the embassy site:-
"Foreign-born minor children are not eligible for OCI if both the parents are Indian citizens holding Indian Passports."
So its clear that if both parents are indian citizens with indian passports the kid cannot get an OCI and has to get the PIO instead.

If you filed 485 for her, the answer should be yes and by whom should be SELF - AOS... this is what i did for my wife and she got her H4 stamped im mumbai

I have a certain queries regarding the transfer from L2 to H1B.
My husband is on L1 and me on L2 with my EAD still under processing. However my husband's firm wants to get his visa converted to H1 which automatically cancels my L2 status and I would have to apply for H4.
So now my query is for how long will his status of L1 be valid will it be till the start date of H1B, or the minute he files in his papers for H1B or when his H1B gets approved?
