What's so immoral about sending them to their home country without splitting families? We are not putting them in prison/guantanamo. The first amnesty was a big mistake and not justifiable. C'mon 8 billion is a expensive? Illegals cost California 10.5 billion a year in welfare, stamps, education...
There have been a number of publications that have shown that the vast majority of the "illegal" immigrants actually pay SS and Medicare taxes. They also contribute to federal and state tax regardless of the benefit that they receive from it. (Some of these publications have been presented in Congress over the years). What some of the right wing folks (like Lou Dobbs) say is that they are sucking the system dry. That is very debatable. The fact that they can only avail of emergency medical care is the fault of the system here in the US.

Not sure if you are aware that a majority of the farmers especially in the South are willing to hire American workers but have had no success. The only thing that the US DOL have managed to confirm is that there is a shortage of workers. Can some of those be filled by American workers? Sure some but not all. Its just that lots of them don't want to fill those positions for various reasons. An American I met a few days ago was telling me about how he was unemployed for almost 3 years. He is a well educated person and didn't think it made sense for him to find low-skilled labor!

Agreed. I still fail to understand how a change in medical insurance can boost the economy or improve unemployment.
The reason there has been this huge push for health care reform is that it becoming a huge drain on the system. About 60% of bankruptcies in the US were due to medical bills. You and I might be lucky that we are healthy and employer paid insurance. Millions don't have that benefit. Also consider that some people couldn't buy insurance because they had hit a "lifetime limit"! So if someone has cancer (which I might tell you is frightfully expensive to treat), and then had a relapse, you could very well hit that lifetime limit. So once you retire, you would have no recourse. Also remember that health care was declared a human right by the United Nations. (see the UNDHR Article 25)

Years we have been told priority date establishes your place in the queue.
We have spurned job offers and declined the new PERM process to hold on to the priority dates.
Many are still awaiting labor certifications from the backlog elimination centers. Out comes USCIS and says everyone with a LC can file I140 & I485.
People still waiting for LC with priority dates in 2003-2004 are seeing applicants who have priority dates as late as 2007 but with approved LCs through PERM walk through to I485.
Net result, USCIS is going to be flooded with applicants enough to retrogress the priority dates 3-4 years back as early as september. (Everybody with a LC will be able to file for I485 in July). So applicants with priority dates of 2007 are going to get EAD and GC, while LC backlogged 2003 applicants to have to wait for another 3-4 years before they can even file I485.

right. in the AILA call also they cautioned that retrogression will become worse (dates moving back!) once USCIS starts processing all those July/August filers...
Once USCIS completes data entry of all 800K 485s (may be with in next month) they will have clear picture. They may give a report to DOS, how many waiting in each catagory (EB1,2,3) with PD with countrywise break out. Then DOS will easily setup the cutoff dates. This may happen in Jan or Feb.
I feel that EB3 India may stay like this (in 2001). EB2 India may go back to 2003 or 2002 , based on how many guys in EB3 with PD 2002, 2003 converts to EB2. All other countries may see slight forward movement.

Yeah, but this also means that they are overwhelmed and can't process and approve 40K cases by July end. So overall, it might be good for us.
1. I-140 processing times have been already adversely affected by almost everyone going in for premium processing... in one case (TSC, EB-3?) it went back to 2003
2. there would definitely be a surge in the I-140's beginning July-- many going in for Premium Processing, which would certainly slow them down, and perhaps, make it impossible to guarantee a 15 day response
4. possibly, they are helping speed up the AOS decisions

I opened the SR yesterday. I still have 40 or so days but the Rep said they take atleast 10 days to decide and if you want to open that should be fine.

Anyway still trying to put some explanation. First of all you need to understand the difference between today's bulletin system and bulletin system prevalent around 1999-2003. I vaguely remember, mostly till 2002 mid only Mexico and Philipines and India were "oversubscribed" countries.INS played a very smart game with bulletins then as well but somehow there was no public cry like what we experienced during this july. I do not remember exactly but probably during almost whole 2003 and perhaps for some months during 2002 India was out from "Oversubscribed" category. Before that India was used to be "Current" almost all the time. Now during the time India compeltely disapperared from bulletins, we needed to solely depend upon the internal news about retrogression and most of the information I was used to get from immigration.com and murthy.com articles and many articles were talking about this EB2 and Eb3 retrogression.

The wild cards are still the LC substitutions and EB2 to EB3 conversions. Even if a lot of people had to go back to India, is there any estimate on how many of these LC approvals were later sold by the bodyshoppers? Depending on the extent of LC substitution frauds (from what I hear it was rampant) all the calculations and estimates could get completely thrown off. I agree that we should wait for another 2-3 months for the dust to settle. Even the USCIS/DOS should have a good idea of how many cases there are and that will help them control the flow better and that should reflect in the visa bulletins.
Perfect linear logic. Infact if you think linearly this should have been the case.But, in my opinion you have missed 2 important events. First, when BECs were created, before moving cases to BECs, INS somehow took a stand of rapid labor approval for those who already cleared "State" process and were waiting in Regional. Many of cases were approved during those 3 to 4 months and most of them were of EB2 categories. Those who were stuck in "State" , most were transferred to BECs directly. Second thing happened was many EB2 people also changed jobs as economy started to improve from 2005 and many left for India. Now one can argue, that happened with EB3 as well. I tell you one thing. My file was Eb3 NON-RIR...Stuck in PBEC. I decided to convert into RIR. My final conversion package sent to PBEC, around second week of January 2007. At that moment there were almost 350000 cased were of NON-RIR and 70000 cases were of RIR. EB2 load was of around 30 % only of these total cases. See here the difference lies in volume. EB3 load is considerably high. One more thing to remember is Most of those EB2 filings were of 2002 or pre 2002. In year 2003, generally most filing were done in EB3 NON-RIR only as RIR denial ratio was high and that with particular EB2 category. And adding all this makes my assumption base that 80% of pre 2004 EB2 lot is already out of this black hole. Let's watch next bulletins. It will be clear within 2 to 3 months how USCIS is taking turns.

My many friends from EB3 -Jan to Jun 2003 PD are still in process. I have met 2 EB2-May 2003PD guys already having GC. Very small sample but thought to mention it.

Anything with the legislative effort aka unused visa recapture will not happen in this political environment.
My only question to the EB3I is,
Do you want to wait until the visa recapture, when ever it happens or will it ever?. More-over this has been taken up by many people in this forum and fizzled. To add more, do you know what will happen when un-used visas are recaptured ? Will it benefit EB3I or will it be given to EB2 just like the spill over. Would you do something right now to atleast get some short term relief to EB3I ?

Rather it would be in their interest to cross port to EB2 since they directly become current rather than wait for spill over to reach their PD which is good 3-4 years away. I would not like to use such words like Leech without knowing the history of a member. It is derogatory.
I am happy that the person joined IV and maybe contributed to it. It is partly our fault that we all did not reach out to such people and convince them enough how they can be a part of the effort. Such members with few posts may be still thinking of IV just as forum for posting their case questions. They may think of IV just like any other tracker site or forum. If it is true then it is also a fault of each one of us because we have not raised the awareness enough. It does not really matter if they post 100 times or 1 time. There are some donors who have less than 10 posts but they have been silent supporters of IV as donors for a long time. Some such people have visited local lawmakers regularly and given feedback of their meetings to IV. Some volunteer their time to IV on regular basis. So its all not about money. They just do not have time to regularly visit IV. But they support the effort one way or another in behind the scenes work or contributing to it.
What I do not like are people who do not care about what we do even though they know about IV. Such people maybe having 1000 posts or no posts. They only contact IV when their own case is having problems. Whether it is EAD delays or I485 denial etc. They could be talking against IV all this time and then suddenly expect IV to devote its time and resources to help them. It is the quality of the community that defines who we are and when we come across such people it is shameful. Last year there was a very active member for several years (never contributed a penny but had 100s of posts) who became current. He used to post on approval thread like this one seeing who gets approval. When his anxiety level reached high, he sent me a PM saying he will contribute $25 to IV if IV can help as his case is current and USCIS is not taking action. Such are the incidents we come across and we really wonder if these are the highly educated folks we are fighting for. As I have said, the reason why this backlog still exists is because Immigrants stuck in the backlog are ok with it and do not care about removing it. There is no point blaming the system, if people in the system do not complain against it.

There are some donors who have less than 10 posts but they have been silent supporters of IV as donors for a long time. Some such people have visited local lawmakers regularly and given feedback of their meetings to IV. Some volunteer their time to IV on regular basis. So its all not about money. They just do not have time to regularly visit IV. But they support the effort one way or another in behind the scenes work or contributing to it.
What I do not like are people who do not care about what we do even though they know about IV. Such people maybe having 1000 posts or no posts. They only contact IV when their own case is having problems. Whether it is EAD delays or I485 denial etc. They could be talking against IV all this time and then suddenly expect IV to devote its time and resources to help them. It is the quality of the community that defines who we are and when we come across such people it is shameful. Last year there was a very active member for several years (never contributed a penny but had 100s of posts) who became current. He used to post on approval thread like this one seeing who gets approval. When his anxiety level reached high, he sent me a PM saying he will contribute $25 to IV if IV can help as his case is current and USCIS is not taking action. Such are the incidents we come across and we really wonder if these are the highly educated folks we are fighting for. As I have said, the reason why this backlog still exists is because Immigrants stuck in the backlog are ok with it and do not care about removing it. There is no point blaming the system, if people in the system do not complain against it.

Thanks for your confidence in me, but it is all relative, I think I am a slow, average runner, slower than most of my running friends.
When I started running 10 years ago, my goal on the indoor track was to go around the track 2 times without having to stop and walk. Those 2 rounds made up a small distance of less than a quarter of a mile! So you see, small goals can one day lead you to a 26.2 mile goal as well :)
