I have a question regarding an appeal I did a year ago for a rejected LC.
I have an approved LC and I-140 on an entry level position (EB3) with my company. after I got a promotion to a senior position that requires a masters degree but with a smilar job description but more senior and supervisory responsabilities with the same company. after promotion, I filed for a new LC (EB2) but it got rejected because DOL thinks it is the same position as the already approved LC. my company and I wrote a letter as an appeal on Sep 2006 within 30 days from rejection of LC to BALCA explaining that new position requires a masters degree and it is a senior position with more supervisory duties. as of today, almost a year later, we haven't heard anything regarding DOL (BALCA) decision on my appeal. is anybody in the same situation?? what should I do next?? also I read somewhere that DOl might revoke the already approved LC EB3 after I filed a second LC for EB2 with the same employer. can DOL revoke the first LC EB3 after I have an approved I-140?? please help. a lot of companies are already getting their patent filing work done by attorneys and paralegals abroad. Wont be too long before your I-485 filing is also prepared from outside the US :)
My question is what will the attorneys and para legals do in the US, if they don't find sufficient cases to sustain their operation? What they studied here is not portable for other countries like software.

I applied for my wife EAD renewal on May 3, 2010 at Dalls Lock Box Office, following is the message i got from USCIS today:
Your USCIS application/petition has been received and routed to the California Service Center for processing. Within 7-10 days by standard mail you will receive your official Receipt Notice (Form I-797) with your Receipt Number
WAC12345678901223. With the official Receipt Notice (Form I-797) you may visit USCIS Home Page (http://www.uscis.gov) where you can check the status of your application using My Case Status. We suggest you wait until you have received your Form I-797 before checking My Case Status.

I have a 11 pages PERM, where can I see in which category was certified. I don`t find any information. Please advice.
I think it is on Page 2 (Section H: Job opportunity information) --> Item # 4 = Education: minimum level required. If it is checked as "Masters" or "PHD" it is EB2, if not it is EB3.
This is my interpretation. It took my 3 months to get my job profile changed from Masters preffered to Masters Required. Hope this is what it is. I have been assured by my lawer it is EB2

why would EB2 retrogress to before 2003? It was at 2003 for a long time (8 months?). The only people still with PD of EB2 2002 are the ones just getting out of BEC, there cant be too many of them...

I agree with you that this isn't just fair to people who are stuck in DOL. People who have been waiting for years together will continue waiting while people who got their PERM approved as recently as this year will file for 485. Where is the justice in this? I guess DOS & USCIS have not clue what they are doing as far as the PD's are considered. Couple of months back they had retrogressed as far as 2001 (EB3) & 2003 (EB2) and now they have all become current. How can this possibly happen?
Few of my friends purchased pre-approved labors paying thousands of dollars (which I don't approve anyways) and now they feel cheated having wasted the money for nothing.
I am happy that at least the recent applicants do not have to go through the ordeal which most of the members of IV had to deal with for few years now. My sincere hope is that they value their GC as much as people who have been stuck in this backlogs. It would be a very ungrateful of them, if they think that getting GC's is a piece of cake and it can be obtained in a year. I hope & pray that PD remains current for few more months so that people stuck in DOL have an opportunity to file their 485's soon.

But would you rather have seen USCIS waste over 40000 visas by the end of the year without any PD movement (as reported by some on this forum)? We would have had another thread here blasting the inefficiency and unfairness of USCIS.
Bottomline, I would not like to work in USCIS right now.. They are basically damned if they do, damned if they dont. That said, I do hope that BECs get their act together like USCIS is trying to and get everyones labor cleared by the deadline before the next retrogression hits.

Once we have a sizable number of people to take initiative this effort can be successful. It is difficult to divert attention and resources for a single person. Each immigration issue that our community faces is important to the person suffering from it. IV is a place where people can get together and do something about fixing it.

Now you are going to tell me, my higher education is due to IV, me coming to US is due to IV, me getting bachelors, masters, phd is due to IV, me getting H1 B visa approval and stamping, My getting EB 2 filed approved is caz of IV. , labor approval, 2 yr eads, medical appointments are all due to IV. Get real.
When I was in trouble, I threw some money at Ms Sheela (not Sheela from sheela ki jawani) and voila , I had solution for my problems. IF we are legal here, we need to be afraid of anything, else glad to go back home.

Are they not going to give the same message that you see on the online status page? How different is the case status info going to be from the online status page? I am curious to know ... so that I can call too.
Yes...but after they verbally repeat the same status message as the one online, politely request to be transferred to Level 2. Level 2 typically has a little more info on your case than the customer service agent that picked up your call initially.

My ADD says "BS with 5+ years of progressive experience "
I have a 4 year engg degree from India and have over 10+ years of experience. I am filing for a PERM application that I want it to be eligible for EB2.
Currently in my lawyer's paper work job description does not mention progressive experience. My experience letters does not mention progressive experience. Will this cause a problem.

This Bill will help ALL people, not only the people who have an advanced degree from US!. With the addtion 55k, the people who have an advanced degree will get the green card immediately. Then, they will be out of the queue. Then all the existing anual visa quato will be allocated to the guys who don't have the advanced degree. This is a great bill for all EB forks. If this bill can be passed, the EB2 will be current . and EB3 will be current in two years. some people just didn't get it.
I might be wrong, but I read somewhere that these numbers would go to those working in math or science related fields AND who had graduated with a related degree in the last 5 years.
Again, I'm not 100% on it, just wanted to check if anyone else heard the same.

I received EAD card today. I e-filed on May 8th. Somehow i got 2 years validity eventhough my PD is current. But no worries i have atleast EAD to work on. All the best who are still waiting!!!
