The status on my son's EAD ( first time) changed to card production ordered, while EAD renewal of myself and my wife still shows received and pending. All three applications were e-filed (TSC) on July 4, 2008.

Generally the trigger to cancel previous visa is if you have been approved a new visa. From my personal experience the consulate officer upon determining (after interview etc) that you qualify for H1B will cancels H4. If for some reason you do not qualify for H1B there is a good chance that they will not cancel H4. In any case she can always reapply for H4 if for some reason they cancel H4 without approving H1B which is very unlikely.

Interesting thing I just saw on the CGI Houston website. Here is the link -

It says that effective April 7, 2008 only online applications will be accepted. Ofcourse one has to send the documents by mail. But another interesting thing that I saw on their site was that they say the following -
Processing time for applications received at the Consular counter is between 4 to 7 working days, excluding the date of receipt of application at the Embassy / Consulate.
Processing time for applications received at the Embassy / Consulate is between 4 to 7 working days, excluding the time taken in mail.
This means that irrespective of the method of application(mail or in person) the processing time is the same :)

This would actually be a good idea. Then there would be more Visas available. Especially people with US Degrees. Most people with US degrees dont need to work for this fraudulent consulting firms. They are able to find real jobs with real US employers.
Do you really belive that corporates will do all the pointers mentioned in the bill and hire a international student on H1B.
If this bill is enacted existing H1B's will be thrown out over the years, and by that times corporates want to hire a MS after doing all the pointers of this bill something else would come up to screw you.

The objection by house members to this bill is the easy way out for the reps, who are in trouble for a million things such as high gas prices, another Vietnam type bogging down in Iraq, high spending on medicare etc. The only way for conservatives to curry favors with their base is to throw in the defense of marriage bill, and do nothing about the CIR. The next few days will be critical for the bill. It dies or goes to the conference where it might come out radically changed.
I am opening a new thread to post all updates on the CIR. It seems today is a crucial day when the house comes in session and work on forming the committee might start. If people hear any updates you can post in this thread.

It sure is going to be a difficult task to have this bill passed since house has republican majority and they are saying in the media that they will not have the bill passed.
"Report indicates that the House hardliners who opposed the Senate-passed S. 2611 have come up with a weapon to block the House-Senate Conference Committee and the S.2611. The weapon they have hammered out involves a constitutional issue as to whether the provision in S. 2611 that requires guest worker applicants to "pay the back taxes" as condition for the legal status constitutes a federal government's measure to raise the revenue. These hardliners argue that the U.S. Constitution mandates that any legislation to raise revenue for the government must originate in the House and S. 2611 violated the U.S. Constitution by originating such legislative bill in the Senate. When the Congress returns on Monday, there will be a see-saw fight between the S. 2611 proponents and opponents on this legal technicality issue. One wonders how the House hardliners would defend their prior violations in the past in another legislations that involved such legal technicality issues. Besides, there is no clear definition as to whether such back-tax payment requirement indeed constitutes a revenue raising measure. "

We EB3 folks are not requesting for EB2 visas. We all will be happy to get 50% EB1 spill over visas. The other 50% can go to Eb2s.
right now 100% of EB1 spill over is going to EB2.
Where were you for these many years when DOS was giving out all EB1 spill visas to EB3 ?

For EB3 (All countries) to see some light, the changes made recently to the allocation of excess visa, spill over and also to over subscribed countries need to be revisited. Not sure, what triggered USCIS / DOS to revise the interpretation after so many years. Did IV had any role on this, or not .. do not know.. I ask this as based on all forum updates, IV appears to have little success in the Admin Fix area. I have posted this so many times in various threads and did not get an answer, may be there is none. If the interpretation was somewhat like before, EB2 /3 both would have got the spillover... and all would have benefited in the order of PD. Now with the new interpretation. all excess / spillover visa just goes only to 2 countries (EB2 India / China). Looking at the latest numbers based on USCIS website, China has far less cases compared in India based on the cut-off date, which is good for India (EB2), as they now consume a big chunk of the numbers and rest are left out for now. I am not sure, what is opinion on this from folks from ROW (EB3) on this. Does IV has any comment on this... Having said this, I have nothing against Eb2 or EB2 India specific, and not getting into the argument whether or not EB2 need to given much preference..
