    We have had phone and email campaigns in the past. Phone campaigns work the best when a specific bill is being debated and there is the target 2-3 days campaign. The rest of the time, person-to person presentation is the best.

    Yes, I'm in for person to person too. Will check the NY chapter.
    The next step is to motivate others. Maybe persons would be more interested if we go out in small groups. Combine it with some other activity. Sometimes travel for chapter meetings can get tough for some, with families, could combine with skype.

    There was also a hidden joke about outsourcing phone calls ;)

    One more idea

    For Those who had spent more than five years in the US paying Federal Taxes, are highly skilled (MS) in STEM fields and has been delayed due to name check or Backlog etc. 5 (or 3 yrs) period should be counted from the date of receipt of I-485. (They definately need to get GC before they can apply for citizenship, counting this period)

    Well I really think this is reasonable suggestion to factor Priority Date to determine eligibility for citizenship. It could be 5 or 10 years past your priority and only after approval of green card. Currently many people wait for 8 to 10 years for green card and another 5 years to be eligible for citizenship and some lucky ones get green card in 2 to 3 years and citizenship in another 5 years. System should somehow be balanced to have close to uniform wait times towards citizenship for all.

    Will the reply be made public? Grassley and Durbin wrote to TCS, Infosys and other big bodyshoppers with a list of questions. The replies were never made public.

    I have to renew my passport from DC.

    In the documents mentioned, "Proof of residence", I am staying in an apartment.

    We don't have lease agreement, it is month to month. Also, the phone bill is in my spouse's name.

    Please guide me what should I take as Proof of residence ? Is driving license photo copy sufficient?


    Also, my US visa is expired in my current passport but I have my H1b is till 2012.
    Will this be an issue?

    I'm from ATL and the latest i could get an infopass at ATL local office is on August 12th. My EAD expires Aug 22nd. I will have to ask him what to . Does anbody know if there is an interim EAD and if so, will they give it immediately or is there a "process" for that also.

    Why can't you search for preapproved labor to file I485 quickly?


    I have my own labor approved with a PD of 2004 and 140 pending. Thanks for the suggestion.

    You know what some desi companies are sending emails too , saying they have pre approved labors....

    It is totally unfair for the people whose applications are pending in BECS since 1999.

    Hahahaha... that's my ironic laafter!
    Every one got a nice GPL again this month - yet no one really wants to do anything... why?

    Because "Chal raha hai to chalne do" ... the usual Desi mentality...

    All this sounds crude - but its true. Truth is almost always bitter... like the VB every month!

    I just donated to IV ... gimme REDs if you want, I care the least ... all I really care about is the GREEN (card)...

    Good luck fellowmen, we are all together in this boat - all we need is a mass awakening for the lawmakers to our state of being!

    Thank you. The community needs to wake up. Times are going to be tough not just for H1B but for everyone else in line for GC.
    Advocacy is a long term process that requires lot of efforts and resources. We should not be expecting quick results because of one month's contribution. That is peanuts when you compare it with the amount being spent against us.

    It is high time people join the state chapters and try to lead them if your state chapter is dormant or inactive. Action items will happen but we need to be ready. Try to get more people in IV. The mantra for success will be mass participation in the coming times. It should not be a couple of hundred phone calls or faxes that happened last year, but hundreds of thousands of calls, faxes and thousands of meetings.
    If we can achieve that then we will definitely increase chances of success significantly this year.

    This community needs to think how it can increase mass participation on IV and bring everyone waiting in line on IV platform.

    Guys, this is the time to show the core group that we are a bunch of people thankful that there is IV to help us fight this fight.
    We need to stand united and raise awareness and sign up for the $20minimum a month recurring contribution.

    I understand that some of you do intend to contribute and have contributed generously in the past,
    But here are some mindsets, All of us fall in these 4 mindsets.

    1) you probably think "why should I sign up for a monthly recurring contribution program". I am a generous contributor and I contribute almost monthly anyways.
    2) I have contributed enough.
    3) I will contribute if I feel like, when I see something comming out of this effort.
    4) I do not have to contribute.

    If you are in category 1).I can tell you, I understand because I have been a generous contributer in the past. But guys, the reason I signed up for a monthly recurring contribution is that it helps IV know that 'X' amount of funds are guaranted every month, this way they can better plan.

    Category 2) Contributed enough - Okay why dont just sign up for a minimum amount of $20/month once more. What is enough is not enough.

    Category 3) This has been discussed, I do not want to talk about this category of members.

    Category 4) Again - No Comments-

    Lets show the core team that all of us fall in the first 2 categories.

    The last thing we want the core to do is bite their fingers over funds. We want do not want the core to get stressed out over funds. They have enough real work to do already.

    Inspite of being a serious team player, and a generous contributor it took me two days to sign up for the recurring monthly contribution program, so I give all of the ones that have not set up a monthly recurring contribution benefit of doubt. But this is our last chance, I urge you to be one of the 2000 people we need for this effort. Need 898 members

    For EB3 Folks with PD's in early - 2003- there are close to 8742 applicants in front of you That is a wait of 5 more years.

    For EB3 Folks with PD's in mid 2003 and later - There are 14583 applicants in line before you- That is a wait of 10-12 more years.

    Now the only way forward will be to lobby with IV for a legislative fix. Apart from that there is just no option, the sooner people realise that and help IV with advocacy, the better results we will get.

    I am quite confused. My date is June 2002 first week .
    Not sure if it makes sense to Port to Eb2 , but big uknown is how long it would take PD to move up to June 2002.

    Hi Folks,

    My PD is current but my lawyer is saying that I CANNOT file I-485.
    Reason:

    My labor cert / EB2 was originated in Illinois and then amended for Virginia by G-28.

    Since my labor cert approval, i moved to Califonia - same job, same company.

    Now my lawyer is saying that I need to go back to Virginia so i can apply for I-485.

    Question:

    1. Do i have to go back to the same state/location at I-485 filing stage where my Labor was originally approved?

    2. Doesnot Green Card is for a future job?

    3. Can i file I-485 while I am in California and my labor was approved for VA?

    Please advise - thanks

    Year 2001/2002/2003 = 43.21% = 46286

    Number of years to clear off Backlog (2003 and prior) = 46286/4410 = 10 1/2 years

    Up until 1/5/2007 PD was stable at around 5/8/2001

    I think EB3 movement will be very slow based on above calculations

    EDIT: Even if Unused Visas get funneled down to EB3 India > cut the time in 1/2 still looks like 4-5 years to clear EB3 < 2003

    The fact is that most of Pre 2004 EB2 lot is already out of the system. Those who are still in are sufferer of namecheck and BECs.There is no perfect mechanism to determine the ratio but I would guess 80% are out from that group. Second factor what we need to look is Most of EB3 Mid 2002 to Mid 2005 are still in the system. Third factor what we need to understand is that EB3 filing is always more than double of EB2. Fourth fact is that USCIS has to see "FIFO" is followed or not. So end effect would be we will see EB3 India progressing from this December till April 2008 bulletins reasonably. EB2 will be put on hold . End result in summary would be both EB2 and Eb3 will be brought to Middle of 2005 by next June bulletin. Once that happens Eb2-I will moving faster with comparision to EB3-I.

    Susie, I can say quite strongly that IV's agenda is quite officially
    "H1B quota is not an issue that we wish to take any sides on".

    We are trying to reduce the backlogs as a primary goal.

    The main aim is to reduce the backlogs which will also reduce the age out problem, but not fix for those already aged out. Believe me, even if this was the only issue on the agenda, it is hard enough to get this done.

    If we don't fix the backlogs then age out will be irrelevant. Let's imagine that H1B quota is increased, and EB3 ROW never becomes current because of more H1B ROW newbies. Then EB3 India will never get any spill over. In this case new India EB3 applications could easily have a 25 year wait, by which time the primary petitioner will have retired invalidating the whole application. Thus you can see that increasing H1B quota works against us (although the official position is no position).

    I am considering computer modeling this, because I think that the a 25 year wait is very possible with the current scheme (making age out easier to push maybe).

    If there is an opportunity to provide ago out protection without risking the main aim then I think that it will be taken. First we need a seat at the negotiating table.

    Until we get a seat at the table we have the trade off between raising age out complicates things, and raising age out keeps it personal. There has been some debate over the, I think that the professionals recommend "keep it simple".

    My position on this is to raise the age out and other family issues like US citizen children being forced to leave because their parents are. But only raise it with those law makers it will clearly be received well with, and not be a distraction.

    There are other issues worthy of targeting, but they too complicate things, and risk us not getting a seat at the table. For example banning consulting. This could force many to leave, including their children, through not fault of their own. I think that consulting should at very least be grandfathered, and have some other exceptions. But again pushing that would be a distraction.

    As I said, if we get a seat at the table, this issue has a chance.

    We are currently working on getting that seat.

    Thanks for your post, support and understanding as you know many H1B children still age out as do many other children who entered the us legally.

    I am so passionate about this issue if iv decide to do something I would help in any way I could

    I don't know that much about immigration and what I do know, is blurred by the amount of information out there - that said, I do think that a bill that represents the people contributing to the betterment of this county by working in their specific fields is a good thing. And it gives way to a cleaner system to evaluate immigrants. I would rather have heard a no in the beginning than be approved and sit around waiting for the forseeable future.

    Precisely. nice to get a psychologist's opinion.
    I would rather get a defenitve "NO" from them right now than run behind a carrot for 10 years.

    Making us do this and then use and discard for profit is extremely nasty.

    Every company has their business model. If someone doesn't like it, they can for sure move on.
    The situation with your friend though it is bad, that is how they work.
    What else did you expect the manager to do?
    You can't be one step ahead of everybody else in all aspects. There is good and bad working for the socalled losers and traiters. You may get GC in fast track or you may get shipped back when you get sick.

    You envy the ones who got the GC and pity the once who got shipped.

    Oh yes, sick leave, have you worked for Losers and Traiters on site? do they have a sick leave policy for on site slaves? do any one of them have one for sick leave or for that matter anything else? would you send me one from your company?

    My friend was working for Losers and Traiters - got real sick due to neck pain - took leave from work - went to a doctor - doctor suggected him a treatment for a month. Guess what, they shipped him back. Who will have an "idle resource" on site? How ethical.

    I asked them to provide a copy of their US insurance policy and on-site employee handbook. I am yet to get one, besides the manager told me since I am no way connected to Losers and Traiters (who wants to?), I am not allowed to ask for such documents. The poor slave friend of mine went to India and resigned within a week.

    now....from your posts, you seem to be a slave working for the welfare of one of these companies (desi or dcc). Keep up the good work. And don't forget to ask your boss about the documents mentioned above.

    Below is a very good article from the "Economic Policy Institute " that highlights the fact that 2 well known Indian firms have single handedly lapped up 65% of H1B visas last year and have applied for just 69 green cards . Thats a GC application rate of 0.0004%. i Cannot help agree with the facts in this article. I totally agree that firms like these which abuse the system ought to be severely punished and blacklisted, so that geniunine US companies can get their required workers , when they need them .     Why is this wrong? These companies are using the H1B just as it was intended to be used - as a temporary work visa. If anybody is contravening the purpose of the H1B, it is all those companies hiring workers on H1B for permanent jobs by pretending that they are temporary workers and then filing for a green card for the worker.
