Hi!
My friend (in the US, on J1, no HRR) has been offered a position with a Non profit organization. They do not have experience with H1b process and want her to tell them about the process, and how she can work here legally (starting June).
I understand that she will not fall under the quota and does not have to wait till Oct 1st. Can someone please provide information (some links) on the following:
1) Can one do premium processing for H1b (first time for her), even though it is a non profit organization? Or is premium processing only for cases that fall under the cap?
2) I noticed that the fee is:
- 190 for application
- 500 for fraud security
- 750 or 1500 depending on whether there are 25 or more employees
- $1000 premium processsing
- $$$ for the lawyer to prepare and file the petition
Is it required by law that all the application fees be paid by the Employer, or can it also be paid by the beneficiary? I understand that the permium processing fee can be paid by the beneficiary, and perhaps the lawyer fees too.
3) Does the employer need to get any certifications/approvals from the Labor department before filing for H1B?
4) Can the entire process by done online?
I will really appreciate it someone could help with answers to these questions.

One other option you can pursue is to just go out of the country (Canada/Mexico) immediately after quiting your job and get H4 stamping and come back on H4....I would advise to talk to a lawyer regarding the first option.....Good luck with your MBA...

Finaly received the 1-year renewal EADs today. This time there was no "approval notice sent" email/LUD.
albertpinto and other folks who filed in April/May and still waiting...hang in there, you all should be receiving your cards soon. If you haven't already, try filing an SR by calling NCSC. I am not sure if that's what helped in our case, but it can't hurt your chances. InfoPass was useless in our case...the guy flat out said he cannot help us.
Here's a quick recap of our case:

Your daughter will NOT aged out. We filed 485 and 140 1 mo before our son 21-st birthday, got GC 3 years later.

LC stuck in DBEC......I submitted my final documents end of May and hoping to get my LC certified end of this month (fingers crossed).

As I said before, IV should step up for EB3-I/C/ROW cause since policies seem to be working in favor of other EBs (which is good) but EB3 is stuck..
Here are some paths to consider.
1. IV has established relationships with some key politicians through the advocacy days, may be that channel can work
or
2. Allow interfiling with spouse
or
3. Allow folks to file I-485 for an approved I-140 even if the dates are not current
or
4. Have an endless EAD and AP (by endless I mean 5 years)
or
5. Recapture (Tie it to a bill...eg Zoe Lofgren or Feigngold will not sign Finance reform bill unless lost EB visas are recaptured). It will help EB2 folks as well. Give Feingold a call, he is voting no on Finance reform. May be he can kick in something for legal EB folks (similar to cornhusker) and may vote Yes and be the 60th vote.
What I suggest you guys to do is build upon these ideas above rather than destroy it or be sarcastic about it.
They certainly need to consider joining other groups....

Yes, my lawyers have shortlisted cases by PD and EB2/3 categories....and suggested best effort to file before July 31st..(when new fees kick in - guess they want to save the EMployer some green)....

I like pursuing option 3 and 2 at the same time. We don't know if option 3 requires a law change so need to clairfy that. While we prepare the slides/etc I think we should contact USCIS first and while working with them educate the law makers on EB3 category based on the points similar to below.
The fact that EB3 category requires less experience than EB2 shouldn't be looked at as EB3 applicant is less skilled. Infact I have applied EB2 twice and now in EB3 and I do have US masters and 10 + years US experience. It all depends on company's attorneys comfort level.
It shouldn't be viewed as we are taking visas away from EB2. Infact we are requesting realisitic approach to the skill sets. Instead of EB2 Current and EB3 at 2001, EB2 can be couple of years ahead of EB3.
We can come up with many ways to explain the injustice but it is time we ACT. I am with you on this.
Lets not get sidetracked by Mr Skillz with a Z.

Option 1: CIR - This is not in the picture right now. Nobody knows when this is going to happen and I think we should not even bother to look upon this as a short term measure.
Option 2:Recapture of visas - Again this has to go through the legislative process. With the current political climate, it is going to take a tough task to get this one in as well.
Option 3:Re-intepreting and changing the spill over rule: This can be done without any legislative changes and USCIS can be asked to look on this if we can really force them to.
Steps to execute Option 3:
* Collect and consolidate all the data in a spreadsheet from the latest 485 inventory to the yearly reports of adjudicated cases
* Create a what if analysis for the next 3-5 years for EB2 I and EB3 I
* Create analysis to show what will happen with the old rule and changed interpretation of spill over
* Create a nice presentation
* Contact Senators, congressmen, USCIS and walk them through our presentation
Hopefully that can change their mind or atleast we gave our best shot.
Add your thoughts and inputs and let us create a plan on executing this, if folks want to do it.

I will elaborate. EB2 was current untill September 30th 2005. So where does the 2003 "screeching blah blah" come into effect?
Besides ike I have posted countless times...there were only 2000+ approvals for Labor certifications for India between march2005 and october 2005
and only 7000 labor certifications for India between march 2005 and december 2005.
These include a number of labor certifications for other worker categories. I myself saw at least 500 pipefitters and welders and joiners whose labor certification had been approved from Louisiana (maybe cos of katrina)
so if the priority dates have to move for EB2 they will move to jan 2006 (like the chinese have) or remain at 2004
there are also a TON of filers who filed in first quarter of 2005, mainly to stay in the old system, as people were scated of the new one (PERM). maybe 300-400 of those are from where I work (they also incidentally started processing GCs again from Q4 2004 after layoffs in 2001-2003. So expect a bump before we get into PERM, but as you say after March 2005 things should be smooth till 2006 Jan

Every time someone comes up with something new they get shot down here by "certain" other members. They try to find reasons to say it was a bad idea rather than saying something constructive. Give this guy a chance.
Fair enough...I'll wait to see what "constructive" ideas you have to offer regarding this topic. I have seen this beaten to death with discussions and polls and countless posts on analysis, but absolutely ZERO talk of advocacy and/or steps for getting anything in action. If you were to give people something worthwhile to act on or even something that shows your commitment to the cause, I would have no issue.

Just wanted to post that my husband and I finally had our embassy interview for our greencards and are back in the states approved and very happy!
Our interview appointment came very quickly, within 3 weeks of the March visa bulletin. I wish you all the same fortune and hope that the priority dates open up considerably for you all.

I got Card Production Ordered mail for my EAD yesterday (08/12/08). I e-filed on June, 1st and gave finger prints on June 26th. I hope I'll receive my card by Sep, 24th which is when my current EAD expires.
Hope you guys get approvals soon. Couple of my friends also got approved on 12th.

Since the DREAM Act has already got a lot of traction, it might be easier to try to attach the issue of aged-out children with it, rather than trying for something new like amendment to CSPA. A simple amendment will solve the problem for most aged-out children: remove the following words from Sec. 4(a)(1)
"who is inadmissible or deportable from the United States"
That will make the Act apply to all children, not just undocumented. I am sure most congressmen will readily agree, it might actually help change some no votes. It makes no sense to cover only undocumented children and keep other children out.
