No updates since then.. showing "case received and pending". It's been exact 1 month since FP but there is no change to the last update date. It is still showing June 6th. Any idea what could be happening?

Everybody, please calm down. I don't know what the intention of this thread was, but if it is to increase the participation to achieve IV's goals, then I am sure you all realize it is having the exact opposite affect. The only thing happening on this thread is donors and non-donors going at each other in a way of unbecoming of us professionals.
I am sure we can agree to disagree with respect. Think about some of the messages written and you wonder would it be really said if they were facing the person.
I personally don't think bitzbyte is or was berating IV's efforts. All he/she needs is more convincing. And I don't think he/she is alone. If that was the case then we would be having 49000 members donating and the advocacy effort would be a grand success and we would be having millions for lobbying. The fact is that there are more like bitzbyte than the donors. I am not sure where the problem is but there sure is. Heck, I am donor and I don't find myself talking about IV or hearing about IV from colleagues or friends. Everybody has their priorities set and the daily grind to go through. Getting a GC may not be everyone's ultimate goal. There was a time I used to be so obsessed with GC that my whole life seemed to be revolving around bulletins and the disappointment of backlogs. One day I said enough is enough and stopped worrying about it.
But I realized that the question is not about whether and when I get GC, but is it fair, to you and your family, to go through years of this agony. It is not fair and we have to do something about it.

GCPerm, Saralayar, spicy_guy, freedom_fighter and others ........ dedicate your time (30 or 60 minutes everyday) on green card backlog issues. Help us all in this process.

I agree with Randy. I think Ron Gotcher mentioned something very similar. what I am not sure about is:
Can one apply for CP after I-485 been pending with USCIS?? is that possible?? does than mean that EAD and AP will be automatically not valid to be used?? do we have to be current in the VB to apply for CP??

There is an advantage to filing through CP when USCIS is slow to process applications. According to statistics this has been the case for last 10 years with USCIS.
CP approvals are pretty fast and when you apply they do not wait till the dates to become current, NVC process the application to the point where the only thing it needs is a visa number.
For example April 1st when an applicants PD is current NVC will request a visa number for the applicant and any derivative applicants around the 10th of April (this is stadard practice). Then typically in the next 60 days (May or June in this case) schedule the interview. You get the visa after successful interview.
If you filed AOS, USCIS is supposed to pull your case and start working on it when PD become current. From what we hear they do not do this properly, they do not follow establised guildlines (FIFO). CP has a distinct advantage in this regard. Only thing is you do not get to have EAD/AP.

Your wife should be good to stay with your change of employer upto the date mentioned in her current I-94.
I have been in your stage. I changed my employer last year. I asked same question to my attorney from my wife. Attorney said that there is no need to apply for another H4 because of mine change of the employer.
We went this year to india there was no issue to get the new visa stamped on our passport.
Note: I am not an attorney and sharing my experience with you. Please take a legal advice from attorney.

Someone mentioned that all vaccines except for Hepatitis B can be completed in 2 days...Hepatitis B takes 6 months. My PD has become current and I haven't had my medical examination yet. I have to take Hepatitis B since don't have immunization records from India.
Does this mean that I can't apply for my I-485 for the next 6 months until I am done with all my Hepatitis B shots?

I had discussion with Mr.Gotcher about this issue. He said, AILA is collecting information on this matter and they are pursuing with Altanta center. But he does not believe or expect any positive outcome. As said earlier he insist to send a formal complaint with OIG and offered his time/help. As its affecting large group of people he refused to accept any fee. I offered we are ready to cover any expense which he might incurr, but seems like it would be very less and he offered free service. Mr.Gotcher will draft a letter in a week time. What we need now - lot support and signature. We do not need to provide any case number. so I dont believe there would be any consequence. So guys please come forward. Spread this news as much as possible and get enough support. Help yourself and get out of this mess.

My dauther is 22 years and 8 month old.
We have not received an official notification from CIS yet, but she is aged-out according to the way the formula is applied.
I started my case (EB-3) with DOL in Sep.08,05 when she was 20 and a half years old; My I-140 was approved on Aug.02,05. I had to wait almost 1 year for a visa. On Jul.2,07 I sent I-485s and I-765s. We have received the Work Permits and the apointment notices for the biometrics for each member of my family, including my daughter.
I live in Falls Church, Virginia, so I went to Jim Moran's office (my House representative) to explain my case, how the CSPA fails and ask him to request CIS to apply the law in a different way (I would say in the right way). I talked to one of his staffers but he said that the law is very clear about the time the case is considered in process (only considers the time the I-140 was in process). As you know, CSPA does not consider the time in DOL nor the time waintg for a visa (retrogression).
Also my daughter has talked to Senator Webb and he wanted to know how many cases are beeing affected, particularly in Virginia, to see if there are several cases, then something can be done.
I was wondering if any one has heard about any change on CSPA and if someone know where can I find how many cases are being affected by this nightmare or if someone has started something to have this law be doing the right thing: to protect children and families.

I had to wait three and a half years for my labor cert. My son was 18 when it was applied for. I never imagined he would age out. Shows how naive I was with regard to the long labor backlog caused by the 245i mini amnesty of 2001.

EAD Paper mailed on 5/8 to Phoenix Lockbox.
Received on 5/10 as per the tracking number by Phoenix Lockbox.
No receipt notice or the cheques were not encashed. Called the National Service Center and was told to wait 30 days to get the receipt notice. :mad: is anyone in similar situation.
probably should've gone efile route mate. I efiled for my wife on May 17th and received confirmation on May 21st and was able to add the file number to my tracking portfolio the day after efiling.

no they aren't the same. geniuses @ CIS named them pretty close but different.
new one is lower case i-765instr.pdf and the older one is upper case I-765instr.pdf
check the revision date at the bottom, they are different. also check the 'where to file' section on page 8.

I talked to SR and he said that unless I have crossed 90 days , he can not open SR for 765 application. How did you convince him to open the SR for you ?

Well I really think this is reasonable suggestion to factor Priority Date to determine eligibility for citizenship. It could be 5 or 10 years past your priority and only after approval of green card. Currently many people wait for 8 to 10 years for green card and another 5 years to be eligible for citizenship and some lucky ones get green card in 2 to 3 years and citizenship in another 5 years. System should somehow be balanced to have close to uniform wait times towards citizenship for all.

how has our respective motherlands harmed us that despite being pushed around by US for years on end -we are desperately seeking US citizenship?? after all - in many cases - its the basic and advanced education received at our respective countries that has made us qualify as "highly skilled" immigrants here.....

I think your calculation is wrong. If there are 8742 applications then it should take less than 3 years not 5 years. In the 2nd case for 14583 applications the wait would be around 5 years instead of 10-12 years. This is due to the fact that every year around 3000 visas go to EB3 category. Though this is a long wait too so either way we need legislative fix for all the cases.
For EB3 Folks with PD's in early - 2003- there are close to 8742 applicants in front of you That is a wait of 5 more years.
For EB3 Folks with PD's in mid 2003 and later - There are 14583 applicants in line before you- That is a wait of 10-12 more years.
