12 years in US. Engg, PGDCA, MBA(Distance education) grad from India. Had 6 yeras of work exp before joing the current employer. Working with the current employer for 8 years now.
EB3
Priority date Sep 2004
I-140 Approved in Nov 2005
I-485 Filed for both my wife and myself in July 2007
EB2 porting
Started new process with same employer in September 2010
Applied PERM in Jan 2011 and got approved in 10 days
Applied I-140 in April 2011 and got approved in one week
Priority date recaptured and I-140 has the old priority date (Sep 2004) and same A# as previous one
Opened SR with USCIS on May 6th 2011
Informed customer service that my Priority date is outside normal processing time
Received an e-mail after couple of days "There are no visas available to process your I-485 application. Your priority date is EB3 September 2004 which is later that the cut-off listed on the visa bulletin for your preference. Thank you for your time. This inquiry will be considered closed."
Replied to the USCIS e-mail(tsc.ncscfollowup) attaching the I-140 copy and asking them to upgrade my case from EB-3 to EB-2
Got the magic e-mail on May 17th 2011 and also reply for my e-mail

Thanks Lasantha for your reply. I am not sure if employer can call on my behalf and get an update on my application??. I did explain to my employer that to get an update I can call USCIS but they want an update from USCIS in writting to keep it on my employee file in the HR dept. I am not sure if USCIS will reply to the inquiry in writing or not. (I think by law, they have to, right??) what is the mailing address at NSC???
I filed for my I-485 myself without the help of a lawyer.
My employer (a small business) has never gone through the GC sponsorship before me and they are not familiar with the process.
I am not sure if a letter is going to help. I was going to suggest an SR but in your earlier post you said that your SR didn't work either. But if you are going to send a letter then I would suggest sending it to NSC. Your lawyer would have the address.
I also know that sometimes people write to their congressman asking him to look in to the case but I am not sure if that's a good idea.

I thought, 15000 members was a small goal. But I guess we have to start with even smaller goals. I agree with Amit.
There's too much at stake to give up this campaign. Without membership, we are a weak bunch. To fight organized campaigns by groups such as Numbersusa we need the member strength.
Let us aim for 8000 members by Jan 15th. Current membership stands at 7919. We need just 80 members to reach the 8000 mark. If 10% of the current membership brings ONE member by Jan 15th, we can easily reach that target. With 300000 immigrants in this kind of quagmire, cant we get 80 people? I believe we can.
Let's join hands one more time and try to Add just ONE member by Jan15th. It is for our own sakes we will be doing it, so let's do it!!!
Admins,
Please send out an email (monthly newsletter) to all members informing them about this campaign.
Thank you.

Thanks Neelu, rightly said. I added one more member last night.

How to open the SR akhilmahajan? Is it same as the Infopass appointment?
Also, there is no LUD after FP in my case. Does that mean that TSC has not received FP results yet? The post by kartikiran on the same page shows that FP was done on 5/13 but the LUD was on 7/20 when TSC received FP. I suspect the same has happened in my case. Should I check with the FP office?
please give your thoughts..
just called the 800 number and talked to a rep, and she opened a SR for me.

I think the number 8742 is taken from 485 inventory report so it includes dependents
Have dependants been counted as part of the 8742 applicants - or are they just primary applicants?

You will understand later my brother. After you get the GC when you look back. You will say to yourself "Wow, I was being so small and petty minded: I was bashing up real people for a piece of plastic". That is the time we can meet and be friends
Value of a "person" will be known when he is gone. But the worthlessness of material thing gets realized when it actually comes. Character of a person is truly tested during trying times. May you reminisce about it later and wonder why didn't you do better
Good luck. And BTW I was not the guy who gave you red.
About this message: It's not just for MC, but many, many more of you. Is it really important that you won the race in life, more than how people remember you? I am not "targeting" anyone in particular, just indulging myself with some philosophy. Peace.
On the same note guys..Nothing changes after GC.. I have always lived with this thought..If i want to go live back in India, I dont need a GC, If i decide to stay here in the US, It does not matter when GC comes..as long as u have legal status that you can maintain ( I know may not be for everybody ..esp who are in the clutches of the consultants)...most of you guys can change to job of your choice and maintain status..Without a GC, i have done everything you can do with one..( Job change, House buying , what else?)...So while i know it is a comforting feeling to have a GC, dont let that drive you crazy...the system is as fair or as unfair as it can be, it is how u look at it..Just chill ..good things will happen. Wishing you all the very best

- Issue one time executive order to grant green cards to those who have Priority Dates older than 7 years.
- Visa re capture if above two are not issued.
- Count primary applicant as a visa number and not dependents.
- If none of above are done at least deny/approve I-485 application as soon as possible and issue green cards later so that applicants know what they should do with their lives.

No impact on BEC approvals on retrogression, BECAUSE THEY NEED TO GET I-140 to be approved, then only their case to be on the line for visa number. Now no premium processing, their I-140 is going to get approved dring May OR June 2008. Till then the guys with I-140 approved and filed in June 2007 get GC. BEC approvals on 2001, 2002, 2003 cases after june 30th (last date for premium) will be on above catagory.
I agree with you. That's the reason I feel USCIS is just taking time to get their act together and move forward with PD.
I am very doubtful that DOS would open the gates completely next July (like this year) as they had very bad experience. But EB3 dates may move to early 2005 (March 2005 may be - before PERM was launched) and EB2 close to 2006.

The USCIS will send you a summons for your fingerprints. You will have to go to wherever they mandate. The fingerprints only have a fifteen month validity.
The medical exams are usually a two day event. One day to do the exams and then they write up the report when they get your blood work results from the lab.
While you are waiting you can work on developing the patience of Job.

Maybe my case is an exception and it might give hope to others. I got my PERM labor certified recently after being audited. It took 215 days from the day of filing to approval day. I'm in EB2 category.
Don't lose hope as there is no apparent rationale behind DOL's approval.

Three unbelivable things had happen in DC.
1. Aman forgot his cell phone in the Cab. This phone had all the important contact information. One passenger using the cab found it and he decided to return it to the owner of the cell phone. The passenger did not want to give his cell phone to the cab driver since there is no guarantee that the cab driver will return the cell phone to Aman. He therefore decided to find the passenger (Aman). The passenger asked the cab driver who was sitting in this cab before he took this cab. Where did he dropped the passenger (Aman).
The driver brought that passenger at the Washington Monument. The passenger asked the driver to find Aman. The driver found Aman and the cell phone was returned.
2. I forgot to get my laptop from the cab. The cab left after dropping me, Kushal and Ashish at the hotel. The only thing we knew was the color of the cab. The laptop carrying case had important IV documents, checks that some members had contributed and my personnel check book. Ashish and Kushal were helping me to find the cab company waiting outside the hotel on the road. We spent approximately 2 hour waiting on the road. Kushal kept calling each cab company informing that we have forgot to collect the laptop from the hotel. Ashish kept collecting the phone numbers of the different cab company.
Not only that Meenal who was attending different meetings in capitol hill kept asking different cabs about the ways to find the cab and laptop when she get some time between the meetings. At 6:30 PM Aman, Tamsen, Nili, Meenal, kushal, Rajesh, and I met at Bombay palace for the dinner since we all were very hungry. Aman told me that we will dedicate the whole day Wed. to find the laptop and he was very confident that we will find the laptop. Tamsen was trying to find the cab company on the internet using color combination. I can see that everyone was concerned and were wishing that I get my lost laptop back some way.
At exactly 8:36 PM I got a call from one passenger who was living in VA and told me that he had my laptop. He along with his wife came all the way back to DC capitol (45 MINUTES DRIVE) just to return my laptop.
3. Whoever have came to DC for this rally had met real IV members. I have not seen or met any individual who said that he or she made a mistake coming to DC for this rally. This was an unbelivable event. People who did not came to DC for sure made a mistake of deciding not to come to DC for any reason.
Cheers

Many congratulations!!!!!!!You must be on the 7th heavan. Enjoy this day and celebrate it every year henceforth.
So the 15 month FP validity is also a bogus. Yours seem to be a straightforward and non-transferred case....it is good to see choronological approvals than random.

I agree,
Sadly, there is no commonsense or compassion shown by the current immigration laws
The Dream act is seen by many as nothing more than an amnesty. If only they would only focus on the illegal children and include all other legal children and never reward their parents with a green card I feel there could be a workable solution so this act could go through
I have left a message with Durbin's legislator to contact me to try and get appointment to discuss and willing to fly anywhere at my own cost

They also told me to contact NSC to get tracking no. I called NSC and and got the USPS tracking no's. No change in status online at USCIS, no email or SMS from USCIS.

Hastert Deals Blow to Immigration Bill
By SUZANNE GAMBOA

WASHINGTON -- Hopes for a quick compromise on immigration were dealt a blow Tuesday after House Speaker Dennis Hastert said he wanted to take a "long look" at a Senate bill offering possible citizenship to millions of illegal immigrants.
Hastert said hearings on the Senate bill should be held before appointing anyone to a House-Senate committee to negotiate a compromise immigration bill. Later, he said he was unsure what the House's next move would be.
