Remember, you are signing each and every form. Which means you are certifying the following: "I certify, under penalty of perjury under the laws of the United States of America, that this application and the evidence submitted with it is all true and correct."

So when a form asks for your address, it HAS to be YOUR address. Providing any other address would be illegal. Tell your employer he/she cannot force you to commit perjury.

hi everyone

I m an MBA(major:general mba)student in a university in texas. I have an bachelors of engineeing (electrical & electronics)from india. I have found an desi employer who is ready to train me in SAP (FICO)functional and than place me on projects to diffeent companies. Since i m graduating in august 2008 ,At first i have to work for him on OPT and than in apil 2009 my employer will sponcer my h1 visa.

Now my question is....
1) can i work in SAP FICO functional , when i m on my opt?(opt means i have to work in a job directly related to my major field of study and i guess SAP is not related to my field major field of study)

2)will i have problems getting a h1b visa? (since General MBA and SAP are completely different fields )

Any comments or suggestions will be appreciated.

My wife is from Bangalore, however since Chennai did not have available dates till Jan 20th she has scheduled her H4 appointment at New Delhi for Jan 9th. Please share experiences.

Inorder to take the priority date with you, the I140 petition (after the labour approval) needs to be approved.

I think there is no way you can take your priority date with you just with labour approval.

I am going to file application for renewal of EAD of my spouse.She was on H-4 when she came to USA and she got EAD last year. She will start working from Aug 08. She has not used her EAD till now but went to India on AP.

1.What is manner of last entry and the current immigration status for her? Is it Parolee or H4 status in both cases?
2.I have filed I-485 after July 2007. Can I E-file? As I read somewhere on forum that On or after July 30, 2007, applications may not be electronically filed and must be submitted to a Service Center via regular mail or courier service.

got few answers ... searching from other sites.

I-130 does play a role, when applying for visitors visa. but that doesnt disquialify anyone from getting visa. you have to show string ties to your country and provide enough evidence that you will come back. there are cases where they hv granted 10yrs multple visas !!

Can somebody file 140/485 if labor is approved today July 18th based on the new directive? How about future Labor approvals, say August 5th? Could somebody plz throw some light on this?
If you labor is approved by July 31st, you can file your I-485 by August 17th.

If your labor is approved on Aug 1st or later, you'll not be able to file I-485 at this time. You can, of course, file I-140.

I have started a thread with similar message. Giving GCs to us means atleast another 10,000 home purchases = $3 billion. A few people here supported that idea, a few vehemently opposed and few was kind of neutral.

Worth pursuing in my opinion.

I am suggesting we should write to White House and to the Ben Bernanke in Mass and draw their attention towards a million people waiting for their green cards, logically they should have already got it(10 years waiting is illogical) but if USCIS use Visa recapture these people can get green cards and green cards to these people means a million new house buyers in the market new cars buyers etc etc. Everybody is going to get green card one day, why not now..That will help bail out the housing market. I'm sure it'll strike a cord with the lawmakers as it will benefit them politically....

I went to Infopass to enquire about my interfile status. The first level officer said since my PD is not current, she will not allow me to meet the IO. I argued that PD has nothing to do with knowing the status and allow me to meet the actual IO. she still did not. What a crap !!!

Hi! I'm H1B holder and my company is willing to sponsor the green card. I'm coming from Eastern Europe (Moldova) and in US am working as software developer, I guess it's EB-3, right? I graduated in Romania Bachelor Degree in Mathematics & Computer Science (4 years) and Master Degree in Computer Science & Engineering (2 years). My work experience is more than 7 years. Hi,
My wife's 485 is rejected with the following reason "The application/petition was filed on the outdated version of this form". The rejection notice has a receive date of July 1st 2010 and a LIN number. Now the problem-

My 485 was approved on July 8th, 2010 and I received a "Welcome to USA" notice on July 12th. My H1 has expired on July 14th, 2010 along with wife's H4 and our I-94's. We applied for both the H extensions in may. Now if we resubmit the 485 with the new application will the USCIS honor the July 1st receive date?


My main concern is on her status, any input will be greatly appreciated.
