Hi,
I applied for H1 and H4 for my Family in 2005. I was working on L visa that time. Our H1 and h4 got approved in October 2005 but we were in India that time. We came to US again on L Visa in 2006.
After coming on L visa my new employer applied for my H1 change of status again in 2006 but not for family. Their H4 from 2005 was valid till 2008.
But Now while I am changing my job, New attorney says that my family is out of status and because we did not file H4 for them again.
What is the alternative to bring them in status. They have vaild i-94 from L2 which is valid till 2009 and they have approved h4 from 2005 which is valid till 2008.
Now my new employer have started my H1 transfer. I am thinking that for my family I will apply H4 change of status once my approval comes. Is that Okay or there is any other alternative to bring them in the status.
My family can not travel to India for H4 stamping till the end of this year. My wife will be delivering a baby in October. Will there be any problem for my new born baby for the passport?
Please advise.

No approvals today or what?
I had to search to find this thread.
What is going on?
The slowness in the approval rate has me a little worried. In July many people got approved at within the first few days - that does not seem to have happened for the first 3 days of August so far. I'm hoping that this is just a blip and the trend picks up shortly.

Wow! it sure varies by a lot..I just spent $190 for the same
It varies depending on the physician. I paid $475 for everything blood work to test immunizations + TB test + Physical exam. This is for one person.
Same physician, my friend went with all medical records and she charged only $250 for doing physical and TB test.
I got the report with in 3 days. Hope this helps. Good luck.

if i know this correctly, there are only 3000+ visa's (green cards)available for eb3 india and there are atleast 8000 people waiting in 2002. a person with a pd of mid 2002 also may need to wait atleast 2- 2 1/2 years before he/she gets their green card.
Dont you want to include the EB3 unused visa from worldwide? just the way EB2 got this time!

We need comprehensive immigration reform now�for fairness, for families, and for our economy.
If we focus on only one aspect of immigration reform, we will not solve our problems. Such an approach unfairly excludes many important interests and groups from a solution. Employers need access to the legal immigrant workforce necessary to keep their businesses growing and should not be asked to act as law enforcement or punished for hiring folks with false identification if they made a good faith effort to authenticate it. American jobs and businesses depend on a comprehensive immigration solution. This drop in economic activity would cost the State of Oregon as much as $656 million in revenue and lower small business income by 8.5 percent. It is time now for comprehensive immigration reform. It is the right thing to do for those who want to contribute to America, for our economy, and for our country. Half measures no matter how well intended undermine our ability to get to the real solution�comprehensive immigration reform.
Although the House of Representatives passed the DREAM Act on December 8, 2010, the Senate failed to invoke cloture, the procedural vote that is required to end debate and allow a final vote. As a result, the DREAM Act was not considered by the Senate prior to the end of the 111th Congress and legislative efforts must begin again in the 112th Congress. The idea about the oath is good. Most of us do great, creative things at work and earn the appreciation of our peers and seniors. Why not we brainstorm now, come with creative ideas to help ourselves?
Let us be open all new ideas. No idea is stupid!
Personally I would think of a mass satyaghraha but not sure now many will like it. It is a peaceful and well tried Gandian method to highlight our plight

Guys, this is the time to show the core group that we are a bunch of people thankful that there is IV to help us fight this fight.
We need to stand united and raise awareness and sign up for the $20minimum a month recurring contribution.
I understand that some of you do intend to contribute and have contributed generously in the past,
But here are some mindsets, All of us fall in these 4 mindsets.
1) you probably think "why should I sign up for a monthly recurring contribution program". I am a generous contributor and I contribute almost monthly anyways.
2) I have contributed enough.
3) I will contribute if I feel like, when I see something comming out of this effort.
4) I do not have to contribute.
If you are in category 1).I can tell you, I understand because I have been a generous contributer in the past. But guys, the reason I signed up for a monthly recurring contribution is that it helps IV know that 'X' amount of funds are guaranted every month, this way they can better plan.
Category 2) Contributed enough - Okay why dont just sign up for a minimum amount of $20/month once more. What is enough is not enough.
Category 3) This has been discussed, I do not want to talk about this category of members.
Category 4) Again - No Comments-
Lets show the core team that all of us fall in the first 2 categories.
The last thing we want the core to do is bite their fingers over funds. We want do not want the core to get stressed out over funds. They have enough real work to do already.
Inspite of being a serious team player, and a generous contributor it took me two days to sign up for the recurring monthly contribution program, so I give all of the ones that have not set up a monthly recurring contribution benefit of doubt. But this is our last chance, I urge you to be one of the 1000 people we need for this effort.

EB3 ROW is at Jun 2004. But as per latest USCIS inventory, EB3 ROW pending 485's are around 48,000. Visa numbers available every year for EB3 is approximately 42k. If you deduct the backlogged EB3 countries (4x3000) visa numbers, the total comes down to 30k for EB3 ROW. So EB3 ROW should become current or atleast Jul 07 in another 1.5 years. If this is not going to happen, it means they are diverting the EB3 numbers to some other categories.

Where is famously liberal "lion" Kennedy in all this. He is the counterpart to Lofgren. When you are the chair of the subcommitte on Immigration you are supposed to be a leader on these kind of issues. Really disappointing.

new one is lower case i-765instr.pdf and the older one is upper case I-765instr.pdf
